LAW No. 6,565/2020 AMENDING ARTICLE 13 OF LAW No. 426/1994 “ESTABLISHING THE CHARTER OF THE DEPARTMENTAL GOVERNMENT.”.

THE PARAGUAYAN NATIONAL CONGRESS ENACTS AS LAW

Article 1 Amend the Article 13 of Law No. 426/1994 “ESTABLISHING THE CHARTER OF THE DEPARTMENTAL GOVERNMENT,” which reads as follows:

Replacement of the Governor

Article 13. In the event of the Governor’s absence, death, resignation, or inability to perform his or her duties, the following procedure shall be followed:

a) Any absence lasting more than three days must be reported in writing in advance to the Departmental Board, and the Chair of the Board shall serve as a substitute for the duration of the absence;

b) An absence of more than fifteen days shall require the permission of the Departmental Board; and the President of the Board shall serve as a substitute for the duration of the absence;

c) In the event of resignation, death, or permanent incapacity occurring during the first three years of the term, the Superior Court of Electoral Justice shall call for new elections within ninety days following the event that caused the vacancy; until then, the President of the Departmental Board shall assume the Governor’s duties on an interim basis. If the event occurs during the last two years, a new Governor shall be elected from among the members of the Departmental Board by an absolute majority vote of its members, to serve out the remainder of the term.

The Governor’s resignation shall be submitted to the Departmental Board, and must be signed and dated, with the signature and date certified by a notary public or justice of the peace of the corresponding jurisdiction, which must acknowledge receipt of the resignation for the relevant purposes within a maximum of three business days; the resignation shall become effective once that period has elapsed.”

The bill, having been approved by the Honorable Chamber of Deputies on the fourth day of March, two thousand twenty, and by the Honorable Senate on the eleventh day of June, two thousand twenty, it is hereby enacted, in accordance with the provisions of Article 207, paragraph 2, of the Constitution.
