The Ministry of Labor, Employment, and Social Security (MTESS) has issued the Resolution No. 1361/2025, which introduces a new procedure for suspending employment contracts. This update repeals the previous resolution from 2020 and will take effect on January 15, 2026.
This new regulation establishes a mandatory administrative procedure that employers must follow to process the suspension of contracts, both individual and collective, before the Administrative Labor Authority (AAT). This is a significant change that requires familiarity with new requirements and documents.
The regulation includes an annex that sets forth specific guidelines regarding the documents supporting the grounds for suspension, in addition to the scope defined in the Labor Code and the formal requirements for filing the request. Furthermore, the Labor Administrative Authority (MTESS) will be responsible for reviewing and resolving such requests in accordance with the new procedure.
